Processing of personal data / GDPR requirements

The legal bases for the processing of personal data are set out in Article 6 of the Data Protection Regulation. The most common legal bases for FMV's processing of personal data are that the processing is necessary:

  • to perform an agreement to which the data subject is a party.
  • to take action at the request of the data subject before concluding such an agreement (Article 6 (1) (b)).
  • to fulfil a legal obligation of FMV (Article 6 (1) (c)).
  • to perform a task of general interest or as part of FMV's exercise of authority (Article 6 (1) (e)).

On the basis of these legal bases, FMV has, among other things, the right to process the personal data that is necessary to fulfil a requirement in law or regulation or to carry out the authority assignments that the Parliament and the government have given the authority.

 

FMV is a government agency. Messages sent to FMV are therefore, as a general rule, public documents that are recorded, registered and which will be disclosed upon request if the information is not covered by confidentiality. As a state authority, FMV must comply with archive legislation with regard to the preservation and thinning of public documents. Personal data included in public documents will thus be handled accordingly.

 

FMV is a contracting authority. Personal data is processed to administer customer and supplier relationships and can be provided and obtained before and in connection with the conclusion of an agreement and the assignment of assignments or otherwise in connection with a customer or supplier relationship.

 

FMV also processes personal data when someone, for example:

  • contacts FMV for information or requests public documents.
  • is looking for a job.
  • signs up for trainings or events.
  • requests access to one of FMV's protected objects.
  • uses a subscription service.
  • contacts FMV for other reasons.

 

In some cases, FMV uses external IT providers and other personal data assistants. Suppliers and others who handle personal data on behalf of FMV always sign a personal data assistant agreement that regulates how the data may be processed by the assistant.

In some cases, there is an obligation for FMV to provide personal data to other authorities. This is done, among other things, to the Security Police during recruitment and to a board or court during appeals.
